By accessing, registering for, or using the CaseMaster.co.in platform, website, application, or any related services (collectively, the "Platform" or "Service"), you ("User," "you," "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and Casemaster Private Limited, a company incorporated under the laws of India, having its registered office at Flat No. 1, Shanti Palace, Bhau Patil Road, Bopodi, Pune-411020 ("CaseMaster.co.in," "Company," "we," "us," "our").
If you are using the Platform on behalf of a law firm, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" shall refer to both you individually and that entity.
1.1 Tool, Not Counsel CaseMaster.co.in is an artificial intelligence-powered software tool designed to assist legal professionals with document synopsis generation, legal research aggregation, and argument strategy drafting. CaseMaster.co.in is a research and drafting assistance tool only. It does not provide, and shall never be construed as providing, legal advice, legal opinions, or legal representation of any kind.
1.2 No Attorney-Client Relationship Use of the Platform does not create, and shall never be construed as creating, an attorney-client relationship between CaseMaster.co.in (or its officers, employees, contractors, or affiliates) and the User or any third party, including the User's clients. CaseMaster.co.in is not a law firm and does not engage in the practice of law in any jurisdiction.
1.3 Intended Users The Platform is designed and intended for use exclusively by licensed legal professionals (advocates, lawyers, law firm personnel working under supervision of licensed advocates, and legal researchers) who possess the requisite professional training, judgment, and licensure to independently evaluate, verify, and responsibly use the outputs generated by the Platform. The Platform is not intended for use by members of the public seeking legal advice, and CaseMaster.co.in expressly disclaims any responsibility for use by unauthorized or unlicensed persons.
1.4 Professional Judgment Required All outputs generated by the Platform - including but not limited to case synopses, timelines, legal research reports, section mapping, precedent identification, and argument strategy reports - are AI-generated drafts and aids only. They are not final work product and must not be relied upon, filed, submitted, communicated to clients, or acted upon in any manner without full independent review, verification, and professional judgment by a qualified, licensed legal professional.
2.1 AI Limitations Acknowledged You acknowledge and agree that artificial intelligence and large language model technology, however advanced, is inherently prone to errors, including but not limited to:
2.2 As Is and As Available Basis The Platform and all outputs are provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, or reliability.
2.3 No Guarantee of Currency of Law CaseMaster.co.in does not warrant that its underlying legal databases, precedent repositories, or statutory references reflect the most current state of law as of the date of any output. Laws, regulations, and judicial precedents are subject to amendment, reinterpretation, and reversal, and the User is solely responsible for independently verifying the current legal position before relying on any output.
2.4 Mandatory Independent Verification The User expressly agrees and acknowledges that it is solely and exclusively the User's responsibility to independently verify all case citations, statutory references, factual summaries, and legal conclusions generated by the Platform before using them for any professional, filing, advisory, or courtroom purpose. CaseMaster.co.in strongly recommends cross-verification of every citation against official and authoritative legal databases before use.
3.1 Exclusion of Consequential Damages and Coverage TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASEMASTER.CO.IN, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE PLATFORM, EVEN IF CASEMASTER.CO.IN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
3.2 Aggregate Liability Cap Amount TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF CASEMASTER.CO.IN ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE PLATFORM, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE USER TO CASEMASTER.CO.IN IN THE MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
3.3 Essential Basis of Bargain The User acknowledges that the limitations of liability set forth in this Section 3 are fundamental elements of the basis of the bargain between the User and CaseMaster.co.in, and that CaseMaster.co.in would not be able to provide the Platform on an economically reasonable basis without such limitations.
3.4 No Liability for Third-Party Actions CaseMaster.co.in shall not be liable for any actions, decisions, judgments, orders, or outcomes rendered by any court, tribunal, judge, opposing counsel, client, or any third party, whether or not influenced by the User's use of Platform outputs.
4.1 User's Sole Responsibility The User acknowledges and agrees that:
(a) The User remains solely and fully responsible, at all times, for all legal advice given to clients, all documents filed in any court or tribunal, all litigation strategy adopted, and all professional decisions made, regardless of whether the Platform was used as an aid;
(b) The User shall exercise independent professional judgment and comply with all applicable rules of professional conduct, Bar Council of India rules, and other regulatory obligations applicable to the User's practice of law;
(c) The User is solely responsible for ensuring that any use of the Platform complies with applicable laws, including rules regarding client confidentiality, privilege, and data protection;
(d) The User shall not represent, hold out, or imply to any client, court, or third party that any output of the Platform constitutes independently verified legal advice or the considered opinion of CaseMaster.co.in.
4.2 Indemnification The User agrees to indemnify, defend, and hold harmless CaseMaster.co.in, its directors, officers, employees, affiliates, licensors, and agents from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
(a) The User's use or misuse of the Platform or any output generated by it;
(b) The User's breach of these Terms;
(c) Any claim brought by the User's client(s) or any third party arising from services rendered by the User using Platform outputs;
(d) The User's violation of any applicable law, regulation, or professional conduct rule;
(e) Any unauthorized or unlicensed use of the Platform by the User or persons under the User's control;
(f) Content or documents uploaded by the User, including any breach of confidentiality, privilege, intellectual property rights, or data protection obligations relating to such uploads.
5.1 User Warranties on Uploaded Data By uploading any document, case file, or data to the Platform, the User represents and warrants that:
(a) The User has all necessary rights, consents, and authority to upload such data, including any consent required from clients regarding confidential or privileged information;
(b) Such upload does not violate any confidentiality obligation, attorney-client privilege, court order, or applicable law;
(c) The User is solely responsible for redacting or anonymizing any information the User does not wish to be processed, where such option is technically available.
5.2 Data Handling CaseMaster.co.in shall process uploaded data in accordance with its Privacy Policy, which forms an integral part of these Terms. CaseMaster.co.in shall implement reasonable technical and organizational security measures to protect User data; however, no method of electronic transmission or storage is 100% secure, and CaseMaster.co.in cannot guarantee absolute security.
5.3 Use of Data for Model Improvement CaseMaster.co.in does not use User-uploaded case documents or data to train its underlying AI models without explicit, separate consent from the User.
5.4 Compliance with Data Protection Law CaseMaster.co.in shall endeavor to process personal data in accordance with the Digital Personal Data Protection Act, 2023, and other applicable data protection laws of India. The User, as the data fiduciary/processor of their client's personal data in many instances, remains independently responsible for their own compliance obligations under applicable data protection law.
5.5 Data Retention and Deletion CaseMaster.co.in shall retain User data for the duration described in the Privacy Policy or as necessary to provide the Service, after which such data shall be deleted or anonymized, except where retention is required by law or for legitimate business/legal purposes (including defense of legal claims).
5.6 Confidentiality of Attorney-Client Privileged Information CaseMaster.co.in acknowledges the sensitive nature of legal case documents but expressly clarifies that it is the User's sole responsibility to ensure that uploading such documents to a third-party platform does not waive attorney-client privilege or breach confidentiality obligations owed to clients. Users are strongly advised to obtain informed client consent prior to uploading privileged or confidential material.
6.1 Platform IP All rights, title, and interest in and to the Platform, including its underlying software, algorithms, AI models, databases, precedent repositories, design, trademarks, logos, and all related intellectual property, are and shall remain the exclusive property of CaseMaster.co.in or its licensors. Nothing in these Terms grants the User any right or license to such intellectual property except the limited right to use the Platform as expressly permitted herein.
6.2 User-Uploaded Content The User retains all ownership rights in documents and data uploaded to the Platform. The User grants CaseMaster.co.in a limited, non-exclusive, royalty-free license to process, store, and use such content solely for the purpose of providing and improving the Service, subject to Section 5 above.
6.3 Ownership of Generated Outputs Subject to the User's compliance with these Terms and payment of applicable fees, the User may use the reports and outputs generated by the Platform for their internal professional and client-service purposes. CaseMaster.co.in retains ownership of the underlying technology, methodology, and any proprietary templates or frameworks used to generate such outputs.
6.4 Restrictions The User shall not: (a) reverse engineer, decompile, or attempt to extract the source code or underlying models of the Platform; (b) resell, sublicense, or redistribute the Platform or its outputs as a standalone competing product or service; (c) use automated means (bots, scrapers) to access the Platform without authorization; (d) remove or alter any proprietary notices on Platform outputs.
7.1 Prohibited User Conduct The User shall not use the Platform to:
(a) Mislead, deceive, or defraud any court, tribunal, opposing party, or client;
(b) Present AI-generated content as independently verified, authoritative legal opinion without disclosure that it was AI-assisted, where such disclosure is required by professional conduct rules or court practice;
(c) Fabricate, falsify, or knowingly submit incorrect case citations, precedents, or facts to any court or authority;
(d) Engage in or facilitate the unauthorized practice of law by any unlicensed person;
(e) Upload unlawfully obtained documents, stolen data, or content that infringes third-party rights;
(f) Use the Platform for any unlawful, defamatory, harassing, or fraudulent purpose;
(g) Attempt to circumvent usage limits, security measures, or payment obligations.
7.2 Consequences of Violation CaseMaster.co.in reserves the right, in its sole discretion, to suspend or terminate access to the Platform, without refund, for any User found to be in violation of this Section 7, and to report such conduct to relevant authorities where legally required or appropriate.
8.1 Fees Fees for use of the Platform shall be as set out on the CaseMaster.co.in pricing page at the time of purchase, which may be revised from time to time with prior notice as described in Section 8.4.
8.2 Billing For subscription plans, fees shall be billed on a recurring basis (monthly/annually, as selected) and shall auto-renew unless cancelled prior to the renewal date in accordance with the cancellation process described on the Platform.
8.3 Refund Policy Except as required by applicable law, all fees paid are non-refundable. Refunds, if any, shall be solely at CaseMaster.co.in's discretion.
8.4 Price Changes CaseMaster.co.in reserves the right to modify its pricing at any time. For subscription Users, any price change shall take effect from the next billing cycle following 24 hours prior notice.
8.5 Effect of Cancellation Upon cancellation or termination of a subscription, the User's access to the Platform, including previously generated reports and case files stored within the Platform, may be restricted or deleted in accordance with CaseMaster.co.in's data retention policy, except where the User has exported such data prior to cancellation.
9.1 No Guarantee of Uninterrupted Service CaseMaster.co.in does not warrant or guarantee that the Platform will be uninterrupted, timely, secure, or error-free. The Platform may be subject to downtime for maintenance, updates, technical failures, or circumstances beyond CaseMaster.co.in's reasonable control (including internet outages, third-party API failures, or force majeure events).
9.2 Modifications to the Platform CaseMaster.co.in reserves the right, at its sole discretion and without liability, to modify, update, suspend, or discontinue any feature, functionality, or aspect of the Platform at any time, with or without notice. Any features described in marketing materials, roadmaps, or communications that are not yet live on the Platform are aspirational and do not constitute a contractual commitment to deliver such features by any particular date, or at all.
9.3 Termination by CaseMaster.co.in CaseMaster.co.in may suspend or terminate the User's access to the Platform, with or without notice, for: (a) breach of these Terms; (b) non-payment of fees; (c) suspected fraudulent, abusive, or unlawful activity; (d) at CaseMaster.co.in's discretion upon reasonable notice for business reasons.
9.4 Termination by User The User may terminate their account at any time in accordance with the cancellation process described on the Platform. Termination does not entitle the User to a refund except as expressly stated in Section 8.3.
9.5 Survival Sections 1, 2, 3, 4, 5, 6, 10, and any other provision that by its nature should survive, shall survive termination of these Terms.
10.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
10.2 Exclusive Jurisdiction Any dispute, claim or controversy arising out of or relating to these Terms and Conditions, the use of Casemaster, or any services provided by Casemaster, including any dispute concerning their interpretation, validity, performance or termination, shall be subject to the exclusive jurisdiction of the competent courts in Pune, and the parties hereby submit to the exclusive jurisdiction of such courts, to the extent permitted under applicable law.
10.3 Class Action Waiver To the maximum extent permitted by law, disputes shall be resolved on an individual basis only, and the User waives any right to participate in a class, collective, or representative action against CaseMaster.co.in.
11.1 No Substitute for Professional Diligence Nothing on the Platform is intended to, and nothing shall be construed to, reduce, replace, or substitute the professional diligence, due care, and independent judgment that the User is bound to exercise under the Bar Council of India Rules, the Advocates Act, 1961, and other applicable professional conduct standards.
11.2 No Responsibility for Professional Conduct Violations CaseMaster.co.in shall bear no responsibility or liability whatsoever for any disciplinary proceedings, professional misconduct findings, contempt of court proceedings, or sanctions imposed on the User arising from the User's use, misuse, or over-reliance on Platform outputs.
11.3 Court and Regulatory Acceptance Not Guaranteed CaseMaster.co.in makes no representation or warranty that any output generated by the Platform will be accepted by any court, tribunal, regulatory authority, or opposing party, or that such output meets the specific formatting, procedural, or substantive requirements of any particular jurisdiction or forum.
12.1 Entire Agreement These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between the User and CaseMaster.co.in regarding the subject matter hereof, superseding all prior agreements and understandings.
12.2 Amendments CaseMaster.co.in reserves the right to modify these Terms at any time. Material changes will be notified to Users via email or in-platform notice at least 1 day prior to taking effect. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
12.3 Severability If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable.
12.4 No Waiver No failure or delay by CaseMaster.co.in in exercising any right under these Terms shall operate as a waiver of such right.
12.5 Assignment The User may not assign or transfer these Terms or any rights hereunder without CaseMaster.co.in's prior written consent. CaseMaster.co.in may assign these Terms in connection with a merger, acquisition, or sale of assets.
12.6 Force Majeure CaseMaster.co.in shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, internet or power outages, government action, pandemics, or third-party service failures.
12.7 Notices All notices under these Terms shall be sent to the contact details provided at registration, or to CaseMaster.co.in at the official contact below.
12.8 Relationship of Parties Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between the User and CaseMaster.co.in.
